New Social Insurance Rules for Foreigners Employed in China

On December 23, 2024, the Ministry of Human Resources and Social Security of China announced a series of updates to the regulations concerning social insurance participation for foreigners employed in China. These revisions, effective immediately, are outlined in the Ministry's Public Notice No. 54 and are designed to fulfill China's obligations under the Convention abolishing the Requirement of Legalization for Foreign Public Documents, as well as to accommodate changes in the naming and coding rules related to social insurance documents for foreigners.

The updated regulations clarify and refine the scope and process for foreign nationals working in China to participate in and benefit from the country's social insurance system. Here are the key amendments:

1. Article 1 has been revised to emphasize the protection of the legal rights of foreigners working in China to participate in social insurance and to receive corresponding benefits. This is in line with the Social Insurance Law of the People's Republic of China and other relevant laws and regulations.
2. Article 2 now defines foreigners employed in China as those who have legally obtained employment documents such as the "Alien Employment Permit" and "Foreign Journalist's Certificate," as well as residence permits, and hold foreign permanent residence certificates, allowing them to work legally in China.
3. Article 7 has been amended to require foreigners receiving monthly social insurance benefits outside China to verify their eligibility for these benefits annually. This can be done by providing a survival certificate issued by a Chinese embassy or consulate abroad, or through an online self-service system as per stipulated regulations. For those legally entering China, an annual verification of their social insurance benefit eligibility is also required, which can be processed online or in person at a social insurance agency.
4. Article 11(2) has been updated to state that employers who hire foreigners without proper employment documents or holding a foreign permanent residence certificate will be dealt with according to the Regulations on the Administration of Employment of foreigner in China.
5. Corresponding modifications have been made to the attachment regarding the "Compilation Rules for Social Security Numbers for Foreigners."

These updates to the "Interim Measures for Foreigners Working in China to Participate in Social Insurance" reflect China's commitment to integrating international norms into its domestic social insurance framework and to streamlining administrative procedures for foreign workers. The revised measures will be republished to align with these changes, ensuring clarity and ease of access to social insurance benefits for all eligible foreign employees in China.
